Special Body judges recommended to the president of the São Paulo Court of Justice Ivan Sartori that he take legal action against the state governor Geraldo Alckmin if he does not release funds that meet the court's needs. The procedures could range from an Action for Noncompliance with a Fundamental Precept since the Federal Constitution provides that the public service must be adequately provided to an action for administrative improbity.
The issue was raised by judge Luiz Pantaleão when analyzing the case of a judge who had her productivity questioned in the Special Body. When accepting the defense of the judge who alone handles more than thousand cases in the district of Cosmópolis Pantaleão stated that that procedure “did not seem to be directed against the judge but against the Court of Justice itself which has not properly structured the first instance due to lack of financial resources”.
With this understanding the judge recommended the “investigation BTC Number Data of the responsibility of the head of the Executive even in relation to administrative improbity if applicable since he is the one who has the key to the public coffers and who does not pass on to the Judiciary what he receives. is due.
According to judge Walter Guilherme de Almeida “taking legal measures against the Executive would not be the final solution to the case but it is a legal solution a legal action”. The judge also told the president of the court that as he well knows “when governors take power they are all always very friendly receptive offer coffee and give a pat on the back. But when we send the budget proposal they always cut it in half and this has been happening for years. Legal action is the solution we must take after negotiations have been exhausted which is always convenient” he highlighted.
President Ivan Sartori believes that the issue will be resolved at the political level but explained that one of the legal measures applicable in this case would be an ADPF before the Federal Supreme Court for noncompliance with the constitutional precept of adequately providing public services.
Warm thoughts
Sartori tried to get around the situation and warm up the conversation by saying that governor Geraldo Alckmin has signaled positively regarding the increase in the new base date for civil servants and the creation of legal assistant positions. The president highlighted the importance of the governor's support as he has the majority in the State Legislative Assembly.
However Sartori was unable to hide his dissatisfaction with the way the negotiations were going as he left with positive expectations after the meeting he had with Geraldo Alckmin last week.
The president of the TJSP left the meeting confident and in the expectation that the new salary base date would please civil servants and that the governor would support the creation of judicial assistant positions. The government's delay in taking a definitive stance on these issues is displeasing the president of the São Paulo court. “The answer should have come last Tuesday and it didn’t. I already tried to contact you today and was unable to do so. I see good intentions from the governor so we should wait a little longer but not too long because our situation is critical stated the president.
